Nuestro despacho laboralista cuenta con un equipo altamente especializado, con amplia experiencia en la contratación y despido de trabajadores, implantación de políticas sociales y económicas, modificación de condiciones laborales (salarios, movilidad geográfica y funcional, etc), reestructuración de plantillas y EREs (expedientes de regulación de empleo), convenios de negociación colectiva y huelgas, así como dirección letrada de los distintos conflictos laborales, tanto en vía administrativa como judicial.

Especial atención merecen las relaciones con altos directivos por su relevancia para nuestros clientes y la particular complejidad de sus contratos (pactos de remuneración, secreto profesional, no competencia, etc.), su extinción y la posible concurrencia con otra clase de relaciones de índole civil, societaria o mercantil.

Nuestro equipo de laboral presta asesoramiento de forma coordinada con diversas áreas de ejercicio del despacho y, en particular, con el área de fusiones y adquisiciones y capital riesgo en la que destacan, entre otros, la realización de numerosas auditorías (“due diligence”) laborales, redacción y supervisión de contratos de alta dirección y la elaboración de políticas de retribución. Igualmente, de forma coordinada con el departamento fiscal, asesoramos en el diseño de planes retributivos y de incentivos, incluyendo, entre otros, planes de opciones sobre acciones, de participación en resultados, de pensiones, etc.

En entredicho el valor liberatorio del acuerdo transaccional de despido

El 5 de febrero de 2015 la Sala de lo Social del Tribunal Superior de Justicia de Madrid dictó una sentencia por la que priva de efecto liberatorio al acuerdo transaccional de despido suscrito entre las partes si aquel no es posteriormente ratificado en acto de conciliación con avenencia ante el Servicio de Mediación, Arbitraje y Conciliación (SMAC).

Novedades en materia laboral 2014

El 1 de marzo de 2014 se publicó en el Boletín Oficial del Estado la Ley 1/2014, de 28 de febrero, para la protección de los trabajadores a tiempo parcial y otras medidas urgentes en el orden económico y social. Ese mismo día (el 1 de marzo de 2014), se publicó también en el Boletín Oficial del Estado, el Real Decreto-Ley 3/2014, de 28 de febrero, de medidas urgentes para el fomento del empleo y la contratación indefinida.

Vencimiento para medidas de jubilación: 31 de Marzo de 2013
